Webinar with the High Court of Cassation and Justice of Romania

On October 20th, 2022, the Court of Cassation took part in a webinar organized with the High Court of Cassation and Justice of Romania, devoted to the theme of the judge of freedoms and detention and the litigation of detention. This exchange is part of the cooperation actions led by the Network of the Presidents of the Supreme Judicial Courts of the European Union. It is the third meeting of the year in this framework.

The purpose of this meeting was to better understand the French and Romanian legal systems in the field of coercive measures, both in textual terms and in practice. Judge referee Romain Leblanc, member of the criminal chamber, presented the function of the judge of freedoms and detention and described the modalities of the contradictory debate before him.

Judge Rodica Aida Popa, judge at the criminal section of the High Court of Cassation and Justice, developed the function of the judge of rights and freedoms and the judge of the preliminary chamber.

The speakers were thus able to exchange during a fruitful discussion on the similarities of procedure between our systems, and the stakes for the judges of the litigation of detention. In addition, these debates were an opportunity to discuss issues of common interest such as the digitization of criminal proceedings and the use of videoconference.

Both speakers concluded with a shared desire to renew this type of meeting on different themes, recalling the attachment of both courts to the dialogue between judges.
