Legal mechanisms to ensure uniform practice: webinar with the High Court of Cassation and Justice of Romania

On 20 January 2022, the Court of cassation exchanged with the High Court of Cassation and Justice of Romania during a webinar dedicated to the mechanisms to ensure uniform practice - Appeal in the Interest of the Law, Advisory Opinion, Referral to the Court for a preliminary ruling on a point of law. This exchange falls within the cooperation between the Court of cassation and the network of the Presidents of the Supreme Judicial Courts of the Member States of the European Union. 

The main subject of the conference was to better understand the French mechanisms in this regard, before confronting them with those of the High Court of Cassation and Justice of Romania, in order to reflect on the potential prospects to unify the case-law. Mr Denis Jardel, honorary dean of the Court of cassation, presented these different mechanisms, with detailed statistics, and developed the draft reforms suggested by the Report of the Commission “Court of Cassation 2030”, submitted in July 2021.

Ms Rodica Aida Popa, judge at the criminal chamber of the High Court of cassation and Justice of Romania, introduced the Romanian procedures and the specific mechanism of the Referral to the High Court of Cassation and Justice for a Preliminary Ruling on Questions of Law.

Both speakers exchanged about the similarities of the two courts’ systems, the importance of these mechanisms to strengthen legal certainty and the dialogue between judges at the national and international levels, as well as about the prospects concerning these mechanisms. At the outset of the webinar, the two courts expressed their willingness to strengthen their close cooperation in 2022, by organizing other seminars on different topics.
