New judges from the Court of cassation visit the Court of Justice of the European Union

A delegation of judges and advocate-generals at the Court of cassation recently visited the Court of Justice of the European Union, in Luxembourg on September 25 and 26, 2023, to take part in a training course on the organization and the functioning of the European Court, and to strengthen ties with the latter.

The aim of the visit was to introduce the judges of the Court of cassation to the organization and functioning of the Court of Justice of the European Union, as well as to discuss key issues of common interest. Indeed, this training course provided an opportunity to exchange views on current case law relating to the General Data Protection Regulation (GDPR), the Charter of Fundamental Rights of the European Union and the preliminary ruling. These talks were delivered by high-level speakers such as Mr. President of the Court, Koen Lenaerts and Mr. French Advocate General Jean Richard de la Tour. 

Moreover, judges also had the opportunity to attend a hearing in case C-753/22, Bundesrepublik Deutschland, on the effect of a decision granting refugee status where there is a serious risk that the applicant will be subjected to inhuman and degrading treatment.

The judges of the Court of cassation had the opportunity to interact with Mr. Lenaerts, President of the Court of Justice, Mr. Bonichot, Judge at the Court of Justice, Mr. Richard de la Tour, French Advocate General, Mr. Gervasoni, Judge at the General Court, Mr. Gaudissart, Deputy Registrar of the Court of Justice and Ms. Schneider, Judgment Reviewer at the Office of the President of the Court.

These fruitful exchanges helped to perfect the support given to new judges and advocate-generals at the beginning of their term of office and to improve their understanding of the issues involved in relations with the Court of Justice of European Union, in particular through the mechanism of preliminary ruling. This training course is in line with the desire to strengthen dialogue between judges, a priority of the report by the Study Committee on the Court of Cassation in 2030.
