Meeting between the First President of the Court of Cassation and the President of the Federal Court of Justice of Germany

On 26 August 2021, First President Chantal Arens received at the Cour de cassation (Court of cassation) Ms Bettina Limperg, President of the Bundesgerichtshof (Federal Court of Justice of Germany), accompanied by Mr Rüdiger Pamp, President of the 7th Civil Chamber and Mr Christian Altgen, Head of the International Relations Department of the Federal Court of Justice.

This meeting takes part of the Cour de cassation (Court of Cassation)’s international strategy to strengthen bilateral cooperation with other European supreme courts, contributing to the creation of a common judicial area. The two heads of court discussed the question of the rule of law, which is increasingly being challenged within the European Union as well as the essential role of the supreme courts. In this respect, First President Chantal Arens announced that at the occasion of the French Presidency of the Council of the European Union, a conference of supreme courts will be organised by the Cour de cassation (Court of Cassation), the Conseil d’Etat (Council of State) and the Conseil constitutional (Constitutional Council), on the role of judges upholding the rule of law. 

First President Chantal Arens and the President of the Federal Court of Justice of Germany also discussed the role of national courts in reviewing restrictive measures adopted by States in the context of the health crisis and the means used to enable the courts to continue their work.

First President Chantal Arens lastly presented the work of the “Commission Cour de cassation 2030”, a study committee convened to organize a broad reflection on the future of the Cour de cassation (Court of cassation), whose report was published in July and of which some of the findings and recommendations are similar to those of the Federal Court of Justice.

At the end of these fruitful exchanges, the two heads of court agreed to continue the discussion both bilaterally and within the framework of the Network of the Presidents of the Supreme Courts of the European Union.
